1. Agreement to Terms

Welcome to 5A-HUB ("we," "us," or "our"). By accessing or using our website at 5a-hub.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

5A-HUB is a SaaS platform providing AI-powered tools, business resources, trading journal, finance tracking, and community forums for entrepreneurs, traders, and business professionals.

2. Account Registration

2.1 Eligibility: You must be at least 18 years old to create an account and use our Service.

2.2 Account Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.4 Account Termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

3. Subscription Plans & Billing

3.1 Free Tier: We offer a free tier with 0 monthly credits and access to limited features including task manager, basic AI tools, general discussion forum, and blog access.

3.2 Premium Plans:

  • Monthly Plan: $14/month - Includes 700 credits per month and access to all premium features
  • Yearly Plan: $120/year ($10/month) - Includes 8,400 credits per year (700/month) and access to all premium features with savings

3.3 Premium Features: Premium subscribers have access to:

  • Finance Tracker - comprehensive income and expense management
  • Trading Journal - track and analyze trading performance
  • Premium Prompts - curated AI prompts library
  • Crypto Signals Forum - exclusive cryptocurrency trading signals
  • Technopreneurs Forum - business innovation community
  • Increased credit allocation (700 credits/month)

3.4 Billing Cycle: Monthly subscriptions renew automatically on the same day each month. Yearly subscriptions renew automatically after 12 months.

3.5 Payment Processing: We use Stripe for secure payment processing. By providing payment information, you authorize us to charge the applicable fees to your payment method.

3.6 Price Changes: We reserve the right to modify our pricing with at least 30 days' notice. Changes will not affect your current billing cycle.

4. Refund Policy

4.1 Monthly Subscriptions: Monthly subscriptions are non-refundable. You may cancel at any time, and you will retain access until the end of your current billing period.

4.2 Yearly Subscriptions - Pro-Rated Refund: For yearly subscriptions, we offer a pro-rated refund for unused months (excluding the current month) if you request cancellation:

  • Refunds are calculated based on the number of complete unused months remaining in your subscription, excluding the current month
  • The monthly rate used for calculation is $10/month (the yearly plan rate)
  • Example: If you cancel after 3 months, you will receive a refund for the remaining 8 unused months (8 × $10 = $80). The current month is not refunded.
  • Refund requests must be submitted through your account settings or by contacting support

4.3 Processing Time: Approved refunds will be processed within 5-10 business days to the original payment method.

4.4 No Refunds for Credits: Used credits are non-refundable. Only unused months of subscription are eligible for refund.

4.5 Abuse Prevention: We reserve the right to deny refunds if we detect abuse of our refund policy or terms of service violations.

5. Credits System

5.1 Credit Allocation: Free users receive 0 credits/month. Premium users receive 700 credits/month.

5.2 Credit Usage: Credits are consumed when using AI-powered tools. Different tools require different credit amounts based on their computational requirements.

5.3 Credit Expiration: Unused credits expire at the end of each monthly period and do not roll over.

5.4 Additional Credits: Additional credit packages may be purchased separately (pricing to be announced).

6. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the intellectual property rights of others
  • Upload malicious code, viruses, or any harmful content
  • Harass, abuse, or harm other users
  • Spam or send unsolicited messages
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape or collect data from our Service
  • Resell or redistribute our Service without permission
  • Share your account credentials with others

7. Intellectual Property

7.1 Our Content: All content on 5A-HUB, including text, graphics, logos, images, software, and design, is owned by us or our licensors and is protected by copyright and trademark laws.

7.2 Your Content: You retain ownership of any content you create or upload to the Service. By uploading content, you grant us a license to use, store, and display your content as necessary to provide the Service.

7.3 AI-Generated Content: Content generated using our AI tools may be used by you for commercial purposes. However, we cannot guarantee the uniqueness or originality of AI-generated content.

8. Data & Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

9.1 Service Availability: We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted access or error-free operation.

9.2 AI Accuracy: AI-generated content is provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of AI outputs.

9.3 Trading/Financial Advice: Any trading signals, financial information, or business advice provided through our Service is for educational purposes only and should not be considered professional financial advice. Always consult with qualified professionals.

9.4 Third-Party Links: Our Service may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

10. Limitation of Liability

To the maximum extent permitted by law, 5A-HUB and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless 5A-HUB and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through a notice on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Termination

13.1 By You: You may terminate your account at any time from your account settings.

13.2 By Us: We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason.

13.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account data after termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Somalia, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class actions.
